1. Who we are

This website at tortimassimiliano.com is operated by LIMURIAN LIMITED (“Torti”, “we”, “us”, “our”), a company registered in England and Wales under company number 15070520, whose registered office is at 57 Brewer Street, London, England, W1F 9UL.

Our VAT number is GB 511823225.

Our atelier is at 57 Brewer Street, London W1F 9UL, United Kingdom.

You can reach us at concierge.torti@gmail.com or 07436050006.

2. About these terms

These terms apply to every order you place with us and to your use of this website. By placing an order or booking an appointment you agree to them, so please read them before you buy.

If you are buying as a consumer, nothing in these terms affects your statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Where anything here conflicts with those rights, your statutory rights prevail.

We may update these terms. The version that applies to your order is the version published when you placed it.

3. Eligibility

You must be at least 18 years old to buy from us or to book a consultation.

4. Our products

We sell two different things, and they carry different cancellation rights:

(a) Ready-to-wear fragrances and body products — items from our existing collection, made to our standard formulations and held in stock.

(b) Bespoke commissions — fragrances created to your specifications following a consultation, including personalised or engraved items.

Because every bespoke fragrance is made to your individual specification, it falls within the exemption at regulation 28(1)(b) of the Consumer Contracts Regulations 2013 and cannot be cancelled or returned once production has begun, unless it is faulty. Clause 8 sets this out in full.

Natural ingredients vary between batches. Minor variations in colour, scent development and wear are inherent to artisan perfumery and are not defects.

5. Orders

Your order is an offer to buy. A contract forms only when we send you an email confirming that we have accepted it and, where relevant, that it has been dispatched.

We may decline an order — for example if the item is unavailable, if we cannot take payment, if there has been a pricing error, or if we cannot meet a bespoke brief. If we decline after taking payment we will refund you in full.

6. Price and payment

Prices are in pounds sterling and include UK VAT where applicable.

Delivery costs are shown before you confirm your order.

If a price is obviously wrong and the error is one you could reasonably have spotted, we are not obliged to supply at that price. We will contact you first.

Payment is taken through our payment providers. We do not see or store your full card details.

Orders delivered outside the UK may attract import duties, taxes and customs charges on arrival. These are your responsibility and are not included in the price you pay us.

7. Delivery

We deliver to the United Kingdom and to the European Union. Delivery costs are shown before you confirm your order.

Standard orders. We dispatch within 48 hours of your purchase. Once dispatched, delivery usually takes a further 3 to 4 working days. We send orders by DHL.

Trade and wholesale orders. Where we are supplying a business, the default delivery period is within 28 days of the contract forming, unless we have agreed something different with you in writing.

Bespoke commissions typically take approximately 1 year from the consultation.

Delivery estimates are estimates. Where no date is agreed, we will deliver within 30 days of the contract forming, as the Consumer Contracts Regulations require.

Goods become your responsibility once they are delivered to the address you gave us. Ownership passes when we receive payment in full.

If delivery is delayed by something outside our control we will tell you as soon as we can and work to minimise the delay.

8. Cancellation and returns

In short: we do not give refunds because you have changed your mind or did not get on with a fragrance. Where something is faulty, we will put it right.

Where you bought from us changes what applies, so this clause is split accordingly.

8.1 Bought in our atelier

If you bought in person at 57 Brewer Street, there is no right to cancel and we do not offer refunds or exchanges because you have changed your mind or are not satisfied with the fragrance. Please take your time with us before you buy — that is what the consultation is for.

If the product is faulty, clause 8.4 applies.

8.2 Bought online — your 14-day right to cancel

Buying online is a distance sale, and the law gives you a cancellation right that we cannot remove or reduce. You may cancel within 14 days of the day you (or someone you nominate) receive the goods.

To cancel, tell us in writing at concierge.torti@gmail.com before the 14 days expire. You may use the model cancellation form at the end of these terms, but you do not have to.

Return the goods to us within 14 days of telling us. You pay the cost of return postage.

We will refund you within 14 days of receiving the goods back, or of you showing proof that you have sent them, whichever is sooner.

We may reduce your refund to reflect any loss in value caused by handling beyond what is needed to establish the nature and characteristics of the product. Opening a sealed fragrance to try it is fine. Using a substantial amount of it is not.

This right does not apply to bespoke commissions — see 8.3.

8.3 Bespoke commissions — no right to cancel once production begins

Bespoke and personalised fragrances are exempt from the 14-day right to cancel, because they are made to your specification.

You may cancel at any point before production begins and we will refund you, less any consultation fee already used (see clause 9).

Once production has begun, the commission is non-refundable. We will always tell you clearly when production is about to begin so you know when this point is reached.

If a bespoke commission is faulty, clause 8.4 still applies.

8.4 Faulty, damaged or incorrect goods

This applies to everything — bought in store or online, ready-to-wear or bespoke.

Under the Consumer Rights Act 2015 goods must be of satisfactory quality, fit for purpose and as described. If they are not:

  • within 30 days of delivery, you may reject them for a full refund;
  • within 6 months, you may ask for repair or replacement, and a refund if that fails;
  • up to 6 years (5 in Scotland), you may still have a claim.

Tell us at concierge.torti@gmail.com with your order number and a photograph where possible.

How to return a faulty item. Bring it to the atelier at 57 Brewer Street, which is usually quickest and lets us replace it on the spot. If you are abroad, or would simply rather post it, you may send it to us instead.

9. Consultations and appointments

Consultations and other services are booked through our booking system, where the fee for each service, and the terms that apply to it, are set out in full.

Each service has its own policy — covering fees, deposits, session credit, and cancelling or rescheduling. Those policies apply to your booking. Please refer to the booking page at https://app.squareup.com/appointments/book/39zfshn4mqe953/L2EKAQYB0FF92/start for the current terms of the service you are booking, or ask us and we will send them to you.

As a general rule, we ask for at least 24 hours’ notice to cancel or reschedule. With that notice we will reschedule or refund. With less notice, or if you do not attend, we may retain the fee to cover the reserved time.

10. Gift cards

Gift cards are issued and redeemed through our payment provider’s gift card system.

  • They may be bought for any value between the published minimum and maximum. The maximum balance on a single gift card is £750, a limit set by our payment provider.
  • They can be sent straight to the recipient by email, or to you to pass on yourself.
  • They may be redeemed against products and consultations.
  • They are not exchangeable for cash and cannot be refunded once delivered, except where the law requires.
  • If an order costs more than the balance, pay the difference by any accepted method.
  • Treat a gift card like cash. We cannot replace one that is lost or stolen, and we are not responsible for a card sent to an email address entered incorrectly at purchase.
  • Expiry, where any applies, is stated on the card at the time of issue.

11. Membership and loyalty

Where you hold an account or membership with us, points and benefits accrue on the terms published at the time.

Points and benefits have no cash value, cannot be exchanged for cash and are not transferable.

We may change the scheme or withdraw it on reasonable notice. Accrued benefits already earned will be honoured for a reasonable period.

We may suspend or close an account where the scheme is being abused.

12. Allergies and safe use

Our fragrances contain natural and synthetic aromatic materials, some of which are common allergens. Ingredient and allergen information is supplied with every product and is available on request before you buy.

Patch-test before first use if you have sensitive skin or a history of reactions. Discontinue use if irritation occurs. Keep away from eyes, out of reach of children, and away from heat and naked flame — fragrance is flammable.

If you are pregnant, breastfeeding or have a known sensitivity, take medical advice before use. If you tell us about an allergy before a bespoke commission, we will work around it where we can — but we cannot guarantee that any fragrance will be free of all allergens, and natural materials contain constituents that cannot be fully isolated.

13. Your account

Keep your login details confidential. You are responsible for activity under your account.

Give us accurate information and keep it up to date. We may suspend or close an account used in breach of these terms, or for fraud.

14. Intellectual property

All content on this website — text, images, formulations, names, branding and design — is owned by us or licensed to us and is protected by law.

You may view and print pages for personal, non-commercial use. You may not reproduce, distribute or exploit any of it commercially without our written permission.

A bespoke commission gives you the physical goods. It does not transfer ownership of the formulation, which remains ours.

15. Privacy

We handle your personal data in line with our Privacy Notice, which explains what we collect, why, how long we keep it and what rights you have.

16. Our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, for breach of the statutory terms implied by the Consumer Rights Act 2015, or for anything else that cannot lawfully be limited.

If you are a consumer: we are responsible for loss that is a foreseeable result of our breach. We are not responsible for unforeseeable loss. We do not supply products for business use, and we are not liable for loss of profit, business, or business opportunity.

If you are a business: our total liability for any order is limited to the price paid for it, and we exclude all implied terms to the fullest extent the law allows.

17. Events outside our control

We are not liable for failure or delay caused by something beyond our reasonable control, including supply failure, strikes, fire, flood, epidemic, or the acts of any government. We will tell you promptly and either extend the time for performance or, if the delay is substantial, let you cancel and refund you.

18. Complaints

We would rather hear from you than not. Contact us at concierge.torti@gmail.com and we will acknowledge within 5 working days and aim to resolve within 28 days.

If you are a consumer in the European Union and we cannot resolve matters between us, you can find an alternative dispute resolution body in your own country through the European Consumer Centres Network at eccnet.eu.

19. General

If any clause is found unenforceable, the rest continue to apply.

If we do not insist on something immediately, that does not prevent us insisting later.

We may transfer our rights and obligations under these terms to another organisation. We will tell you if we do, and it will not affect your rights.

This contract is between you and us. No other person has any rights to enforce it.

20. Governing law and jurisdiction

These terms are governed by the law of England and Wales.

You and we both submit to the exclusive jurisdiction of the courts of England and Wales.

If you live in Scotland or Northern Ireland, you may also bring proceedings in your own courts. If you are a consumer resident in the European Union, you keep the protection of the mandatory consumer law of your country of residence, and you may bring proceedings there.
